Odbytová družstva a konkurenceschopnost zemědělských podniků
Trade cooperatives and the competitivness of the farming business

Tento článek se snaží postihnout základní charakteristiky právní úpravy odbytových organizací a družstev v zemědělském sektoru. Zemědělci a potravináři se sjednocováním snaží vytvořit silnější pozici při vyjednávání s obchodními řetězci. Jedním z nejúčinnějších nástrojů je vytváření zemědělských odbytových organizací či družstev. Úřad pro ochranu hospodářské soutěže ČR (ÚOHS) však vypracoval určitá pravidla, která mají výrazným způsobem upravovat vznik a fungování takových odbytových družstev zemědělců a potravinářů. ÚOHS vychází z názoru, že podniky v oblasti zemědělské prvovýroby a v bezprostředně souvisejících oblastech, jako jsou zásobovací či odbytová družstva, mají povahu malých a středních podniků. Spolupráci těchto podniků soutěžní úprava podporuje, a to i když tato spolupráce obsahuje některé prvky narušující soutěž. Sdružování samo neodporuje dikci zákona, ale vyžaduje schválení Úřadu.

Abstract:
This article presents the current state of legal regulations of the trade cooperatives and syndicates in the agricultural sector. Farmers in the Czech republic and the food industry sector are trying to cooperate together so as to raise the profit of the whole agricultural sector. The most effective way how to achieve this is to create a trade cooperatives or syndicates. The Office for the Protection of Competition of the Czech republic sets out some rules, which will higly impact the creation and functioning of those organizations. The Office for the Protection of Competition has an opinion that an agricultural and food industry cooperatives and syndicates have the same character as small and medium sized enterprises. The cooperation of such businesses is not strictly prohibited by the law, sometimes it is even supported by the competition law, but in some cases it should be approved by the Office for the Protection of Competition.
