Competition Protection In the EU and the Leniency Program

Příspěvek se zabývá postupem EU při odhalování kartelových dohod, který spočívá v aplikaci tzv. programu shovívavosti (Leniency Program). V rámci programu shovívavosti získávají vyšetřující orgány EU (Komise a její úředníci) informace a důkazy o existujících kartelových ujednáních od samotných porušitelů soutěžního práva, kteří jsou k tomuto kroku motivování zárukou, že učiní-li k soutěžnímu úřadu oznámení o kartelovém ujednání, bude jim za určitých podmínek poskytnuta částečná nebo úplná ochrana před sankcemi ukládanými ze strany Komise EU. Tento výsledek řízení by v rámci standardního řízení, zahojovaného pouze na návrh Komise, byl zcela nemožný.

Abstract:
The paper deals with the EU procedures within an innovative approach in detecting of cartel agreements, consisting in application of the so-called Leniency Program. Within the Leniency Program, the practice is that the EU Commission as competition authority obtains the information and evidence concerning the existing cartels directly from its participants. The undertakings that take this step are motivated by warranty, upon certain conditions, of total or partial immunity from sanctions imposed by the Commission in case of cartel investigation. This would be completely out of question in proceedings opened upon notification made towards the Commission by other competitors, which is the standard proceeding form initiated by the competition authorities.
